On August 14, 2020, USCIS conducted a second lottery for the FY2021 H-1B Cap. Employer and/or their representative attorney should have received email notification from USCIS that new H-1B registrations have been selected for submission. In order to check the status of their H-1B lottery selection, they should login their myUSCIS online account which has been used for H-1B registration in the early of March, 2020.
H-1B cap per year is 85,000, among them, 20,000 reserved for those who complete their master or higher degree in the United States. Due to the pandemic of COVID-19, many employers failed to submit H-1 petitions for H-1B candidates who had been selected in the first H-1B lottery in March, 2020. As a result, USCIS conducted a second lottery to fill the H-1B quota for the fiscal year of 2021.
The filing window of the second round of H-1B selection is from 8/17/2020 to 11/16/2020. Nevertheless, it is advisable to file their Labor Condition Applications (LCAs) before October 1, 2020 to avoid any issues. Moreover, employer and employees should be alert that USCIS fee increases and a new Form I-129 for H-1B petition will take effect on October 2, 2020.
